Reference version. This document is a translation. In the
event of any discrepancy between language versions, the
French version prevails.
Document pending review. This version sets out the structure
and the exact facts of the service. The binding clauses — limitation of
liability, termination, disputes, fee schedule, withdrawal conditions — must be
reviewed and completed by legal counsel competent for the jurisdictions from
which you accept users, before any commercial launch.
1. Purpose and acceptance
These terms govern the use of the service available at
aetherion-capital.net, published by Aetherion Capital LLC
(see the legal notice). Creating an
account constitutes full and unreserved acceptance of these terms.
2. Description of the service
Aetherion Capital provides crypto-asset capital management based on an
automated trading strategy. The user deposits crypto-assets, the strategy is
executed by the platform, and the user follows the evolution of their capital
from their client area.
No return is guaranteed. Trading crypto-assets carries a high
risk of partial or total loss of the capital committed. Past, simulated or
displayed performance is in no way indicative of future performance. The
service constitutes neither investment advice, nor a personalised
recommendation, nor a guarantee of outcome. Only commit sums whose loss would
not affect your financial situation.
3. Opening an account
- Opening an account requires a unique username and a password. No identity data is requested.
- The user must have the legal capacity to contract and must ensure that use of the service is lawful in their jurisdiction of residence.
- An account is strictly personal. The user is solely responsible for the confidentiality of their credentials and for any activity carried out from their account.
- Enabling two-factor authentication is strongly recommended.
To be completed. Specify the minimum age required and the list
of excluded jurisdictions, if any.
4. Deposits
- Deposits are made exclusively in crypto-assets, to an address assigned to the user and specific to each asset.
- Each deposit is credited after confirmation on the relevant blockchain.
- The user must send the asset on the network indicated. Sending on the wrong network, or sending an unsupported asset, results in an irreversible loss which the platform can neither reverse nor compensate.
- Transactions recorded on a blockchain are final and irreversible.
5. Custody of assets
Key point. The deposit addresses assigned to users are
generated and controlled by Aetherion Capital LLC. Deposited crypto-assets are
held by the company on behalf of the user: the user retains neither the private
keys nor independent control of the deposited assets. The balance shown in the
client area represents a claim of the user against the company, and not a
direct holding of crypto-assets by the user.
6. Withdrawals
- The user may request the withdrawal of the funds available in their account, to a destination address they provide.
- The user is solely responsible for the accuracy of the destination address. A withdrawal sent to an incorrect address is unrecoverable.
- Withdrawal fees may apply; their amount is shown at the time of the request.
To be completed. Fee schedule, minimum and maximum amounts,
processing times, and the conditions and possible grounds for refusing or
suspending a withdrawal.
7. User obligations
The user undertakes not to:
- use the service for unlawful purposes, in particular money laundering or the financing of criminal activities;
- attempt to gain unauthorised access to the systems, accounts or data of third parties;
- disrupt the operation of the service, in particular through abusive automated requests;
- create multiple accounts in order to circumvent a limitation.
8. Availability of the service
The platform endeavours to provide a continuous service, without being able to
guarantee uninterrupted availability. Interruptions may occur for maintenance,
updates, or as a result of external causes: unavailability of a blockchain
network, failure of an infrastructure provider, or an event of force majeure.
9. Liability
To be drafted with legal counsel. Limitation of liability
clauses are strictly regulated and vary considerably between jurisdictions; a
poorly drafted clause is unenforceable. This section must be established by a
professional.
10. Suspension and closure
To be completed. Grounds for suspending or closing an account,
the applicable procedure, notice periods, and the treatment of funds held upon
closure.
11. Amendment of the terms
These terms may be amended. The date of the last update appears at the top of
this page. Continued use of the service after an amendment constitutes
acceptance of the new version.
12. Governing law and disputes
These terms are governed by the law of the State of California,
United States.

jurisdiction or arbitration) and its interaction with the mandatory consumer
rights applicable in the user's country of residence.
